TERMS AND CONDITIONS FOR LETTING AT MERLION COVE

 

  • The Terms and Conditions of holiday letting as agreed by both parties are as follows. Failure to abide by these Terms and Conditions permits the owner or the agent to refuse the key, amend the rental or apply additional charges and/or terminate the occupancy.


ACCOMMODATION

  • The premises are let to you for holiday purposes only. The tenancy is for the period stated in the confirmation letter and final receipt. The accommodation is for the maximum person per bed per premises booked.


AGREEMENT

  • Nothing in this agreement shall compromise the manager’s or owner’s right to issue legal proceeding in Queensland or elsewhere at its discretion seeking damages and/or punitive relief for any express or implied breaches of this agreement and/or any claim which may arise by reason of the negligence and/or willful damage of the guests and/or invitees whatsoever. This agreement shall constitute the whole agreement between the parties and any express and/or implied warranties imposed upon the manager and/or its servants and agents or its principal by legislation or law of the extent that is possible are expressly excluded.

 
DEPARTURE

  • The premises are to be vacated no later than 10AM and keys are to be dropped off at Merlion Cove office or a late checkout fee will apply.  The premises are to be left in a clean and tidy condition. Failure to do so will incur a charge for extra cleaning. This is additional to the accommodation rental tariff. If a barbeque is provided, a cleaning fee will apply if this is not left in a clean condition.

 
CANCELLATIONS

  • Your deposit, less a $100 cancellation fee & $27.50 booking fee (total $127.50), is fully refundable up to one month prior to your arrival date. If your reservation is cancelled within one month of arrival, the full deposit is forfeited. Should your booking be in Mid or High season, you will be required to pay your balance 30 days prior to arrival.  If you should cancel your booking in this Mid or High season period (or part thereof) all monies are forfeited. If you do not arrive at the property or you do not utilize all of the accommodation booking all monies are forfeited. All booking fees are non refundable. Failure to comply with these conditions may result in your booking being cancelled without notice and forfeiture of any money paid.

 
SUBJECT TO CHANGE

  • We accept bookings in good faith as agents and these bookings may be subject to change. We cannot be held responsible for circumstances beyond our control. That is, if the property is sold or withdrawn from the rental market; the property is altered in any way; or the owner wants the property for their own use; or any other bona fide reason. Tariffs are subject to change without notice. Minimum night stays applies which varies amongst properties. No responsibility is accepted for errors and omissions contained on our web site and ensuing correspondence with respect to bookings and tariffs. We are careful not to misrepresent any rental property. Room numbers and/or complex or house locations are not guaranteed. We cannot be held responsible if the accommodation is unsatisfactory on arrival. No refund is given if you are unsatisfied with your accommodation. In certain circumstances refunds will be given due to health and safety reasons, shortened stay or non-arrival due to extraordinary circumstances. Satisfactory evidence in writing from a guest may be considered. This refund process may take between 6 to 8 weeks. A written refund application will need to be completed for consideration. No guarantee is given that your money will be refunded.

 
DAMAGES, BREAKAGES, LOSSES

  • In the event that the property has been either damaged, whether such damage is willful or not, is the sole and absolute discretion of the manager and/or its servants and agents, or left in excessively dirty or untidy state is the sole and absolute discretion of the manager and/or its servants or agents, an additional charge will be incurred.

 
BOOKINGS

  • All bookings require a minimum deposit of 50% of the full tariff and the balance 30 days prior to arrival. The balance must be deposited to our trust account 30 days prior to your arrival. We do not accept credit cards, personal or business cheques as method of payment on arrival.

 
FUTURE BOOKINGS

  • Please be reminded that reservations are not automatically placed year after year. To avoid disappointment please make your next booking as soon as possible. A deposit must be placed to secure your reservation.

 
PREMISES

  • We cannot accept responsibility for actions taken by the owner of the premises in circumstances beyond our control.  We accept bookings in good faith as agents and cannot be held responsible for circumstances beyond our control.  In the event of any of the following, every reasonable endeavor will be made to find alternative accommodation.
  • 1. The property is sold or withdrawn from the letting pool
  • 2. The property is altered in any way
  • 3. The tariff is altered prior to your stay

 
PETS

  • No pets are permitted on the premises, due to body corporate by-laws.

 
PROPERTY FOR SALE

  • In the event the property is offered for sale, the tenant agrees to allow the owner or agent access to inspect the property with prospective purchasers during reasonable hours by appointment.

 
KEYS

  • Keys to your property are to be collected and returned to our on-site office at Merlion Cove. Please note that any lost or misplaced keys will incur a cost of $40.00 per set, additional cost of $100 if security keys, fobs or remotes are lost or damaged. A $50 fee will also be charged if the agent is called out after 7pm due to misplaced or lost keys to gain access to the property.

 
LATE ARRIVALS

  • Our office hours are from 8.30am to 5.00pm Mon-Fri, Sat 8.30am-12pm, Sun 10am-2pm, Public Holidays 10am-12pm. A late arrival service is available for an additional charge of $11.00. Late arrivals are to call the number displayed in our front office window, you will then be instructed on where to pick-up your keys. We require you to come into the office the next day and formally register. Accommodation is required to be paid in advance for late arrival bookings, prior to the issue of keys.

 
CLEANING & LINEN

  • All linen is included in your tariff.  All of Merlion Coves properties are equipped with kitchen and laundry facilities.  If you require a cleaning servicing we are happy to organize this at an additional charge.

 
CAR PARKING

  • One car space per apartment booking (where applicable) is provided, with only a few exceptions.

 
ADDITIONAL SERVICES

  • If you require limousine transfers, holiday hire or babysitting services, please give us a call. Cancellations of these services require at least 24 hrs notice, otherwise full payment will be required.

 
FUNCTIONS, PARTIES, WEDDINGS, GENERAL DAMAGE & BREAKAGES

  • The properties we manage are for residential accommodation only and penalties apply. Functions of any sort are not permitted. Any type of function, party or get-together could incur a fee of $5,000. All damages, breakages or losses to the property, furniture and furnishings are to be reported to the agent by the guest immediately. Should you discover a default or breakage or maintenance/safety issue when you arrive, please advise our office or we will consider those the responsibility of the current guest and charge accordingly. When a guests registers or an invitee of a guest enters the premises, they are deemed to have agreed to be bound by these conditions. Guests and invitees are expected to behave in a manner, which is conducive to the safety, comfort and convenience of other guests within the property.

 
LOSS, DAMAGE, OR THEFT

  • Agent/Owner takes no responsibility for personal property. This establishment or proprietor of the property shall not be liable to any guests or invitees for any loss, damage or destruction to the property or any personal property brought upon these premises by the said guest or invitee. Without limiting the foregoing personal property shall include jewelry, money and other personal effects and motor vehicles parked on premises. Guests are strongly advised to seek their own travel insurance.

 
GOVERNING LAW & JURISDICTION

  • The law of Queensland governs this Agreement for provision of accommodation. The parties submit to the exclusive jurisdiction of the courts and tribunals of Queensland and agree that any lawsuit or dispute must be heard in these courts or tribunals.
